Taste of IP in China: Protecting IP from Vineyard to Bottle

Taste of IP in China: Protecting IP from Vineyard to Bottle
Date: 9 May 2014
Venue: HKIAC, 38/F, Two Exchange Square, Central, Hong Kong
Join HKIAC in our second wine event with a fictitious story of a successful Chinese wine seller who becomes the target of acquisition by a multinational company. We will examine issues relating to the protection of trademarks and online infringements concerning the use of a domain name in China, particularly in relation to the new trademark law in China and the new generic top-level domains. Licensing agreements, as a route to expanding a brand in Asia, will be discussed in addition to various strategies aimed to pre-empt disputes. An explanation of how arbitration fits into an IP context will also be provided and we will analyse when arbitration is the favoured form of dispute resolution.
Hong Kong Lawyer reports ADNDRC domain name cases

Hong Kong Lawyer reports ADNDRC domain name cases
ADNDRC is pleased to announce that Hong Kong Lawyer (the official journal of the Law Society of Hong Kong) has started to report ADNDRC domain name cases on regular basis in its “Cases in Brief” column.

The coverage of ADNDRC domain name cases aims to provide IP lawyers and brand owners with regular update on rights protection mechanisms under different ICANN’s policies and highlight new issues and trends in domain name dispute resolution.

In a recent case reported in the September issue, the parties resolved their disputes concerning the registration and use of a new gTLD in bad faith via ICANN Uniform Domain Name Dispute Resolution Policy (UDRP). For details, please refer to the online version of the case in brief at

http://www.hk-lawyer.org/en/article.asp?articleid=2384&c=-1

This demonstrates that UDRP is an effective means for resolving new gTLD disputes, as an alternative to Uniform Rapid Suspension System (URS).

More ADNDRC cases in brief will appear in coming issues of the journal. Please stay tuned with Hong Kong Lawyer and us for updated information.
