1. Purpose

This Domain Name Dispute Resolution Policy (the "Dispute Resolution Policy") has been adopted by the Hong Kong Domain Name Registration Company Limited ("HKDNR") and is incorporated by reference into your Domain Name Registration Agreement between HKDNR and you ("the Registration Agreement"). The Dispute Resolution Policy sets forth the terms and conditions in connection with a dispute between you and any party other than the HKDNR in regard to the registration and use of a .hk Internet domain name registered with us by you.

Proceedings under Paragraph 4 of this Dispute Resolution Policy will be conducted according to the HKDNR Domain Name Dispute Resolution Policy Rules of Procedure (the "Rules of Procedure"), see Appendix A and the selected Arbitration Dispute Resolution Service Provider's Supplemental Rules ("the Supplemental Rules"), which are available at the following website(s):-

2. Your Representations

By applying to register a .hk domain name, or by asking us to maintain or renew a .hk domain name registration, you represent and warrant to us that :-

(a)  

the statements that you made in your Registration Agreement are complete and accurate;


(b)
 


to the best of your knowledge and belief, the registration of the domain name will not infringe upon or otherwise violate the legal rights of any third party;


(c)
 


you are not registering, maintaining and or renewing the registration of the domain name for any unlawful purpose; and


(d)
 


you will not knowingly use the domain name in violation of any applicable laws or regulations.

It is your responsibility to determine whether your domain name registration infringes or violates someone else's rights.

3. Cancellations, Transfers and Changes

We will cancel, transfer or otherwise make changes to domain names registered with us under the following circumstances:-

a.  

subject to the provisions of Paragraph 8, our receipt of written or appropriate electronic instructions from you or your authorised agent to take such action;


b.
 


our receipt of an order from a HKSAR court, requiring such action; and/or


c.
 


our receipt of a decision of an arbitration panel as defined in the Rules of Procedure requiring such action in an arbitration proceeding to which you were a party.

Notwithstanding anything else herein contained we may also cancel, transfer or otherwise make changes to a domain name registration in accordance with the terms of your Registration Agreement or other legal requirements.
